Terms of Service

1. Agreement to Terms

By accessing or using Ad Beast ("the Platform") at adbeast.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. These terms apply to all users, including visitors, registered users, and anyone who accesses the Platform.

2. Platform Description

Ad Beast is an AI-powered marketing platform that helps small businesses create and manage advertising campaigns. The Platform uses artificial intelligence to generate brand assets (logos, colors, fonts), ad copy, ad images, and to manage campaigns across Meta (Facebook/Instagram), Google Ads, and TikTok. The Platform is designed for business use and is not intended for personal, non-commercial purposes.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into these terms. If you are using the Platform on behalf of a business or organization, you represent that you have the authority to bind that entity to these terms.

4. Account Responsibilities

When you create an account, you agree to:

  • Provide accurate, current, and complete information about yourself and your business
  • Maintain the security of your password and account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

5. AI-Generated Content

The Platform uses artificial intelligence to generate marketing content, including logos, images, ad copy, and videos. You acknowledge and agree that:

  • AI-generated content is provided as a starting point and should be reviewed before use
  • We do not guarantee that AI-generated content will be accurate, complete, suitable for any particular purpose, or free from errors
  • You are responsible for reviewing and approving all content before it is published or used in advertising campaigns
  • AI-generated images may not perfectly represent your actual products or services
  • We are not liable for any claims arising from the use of AI-generated content in your marketing materials

6. Ad Platform Integrations

When you connect your Meta, Google Ads, or TikTok ad accounts to the Platform:

  • You authorize us to create, modify, and manage advertising campaigns on your behalf
  • You remain solely responsible for all ad spend incurred on your connected accounts
  • You agree to comply with each ad platform's advertising policies and terms of service
  • We do not guarantee any specific advertising results, return on ad spend, or performance metrics
  • You can disconnect your ad accounts at any time through the Platform settings

7. Acceptable Use

You agree not to use the Platform to:

  • Create ads for illegal products, services, or activities
  • Generate misleading, deceptive, or fraudulent advertising content
  • Violate any applicable laws, regulations, or third-party rights
  • Advertise prohibited products or services as defined by Meta, Google, or TikTok advertising policies
  • Attempt to reverse-engineer, exploit, or abuse the Platform or its AI systems
  • Use the Platform to generate content that is hateful, discriminatory, or harmful

8. Intellectual Property

Your Content: You retain ownership of the business information, photos, and other content you upload to the Platform. By uploading content, you grant us a limited license to use it solely for providing the services you requested.

AI-Generated Content: AI-generated assets created through the Platform (logos, images, ad copy) are provided for your use in connection with your business marketing. You may use these assets for your business purposes.

Platform IP: The Platform itself, including its design, code, AI models, and branding, remains our intellectual property and is protected by applicable copyright and trademark laws.

9. Payments and Billing

Pricing details for the Platform are available at adbeast.ai. Ad spend on connected platforms (Meta, Google Ads, TikTok) is billed directly by those platforms and is separate from any fees for using Ad Beast. You are solely responsible for managing your ad spend budgets on each connected platform.

10. Limitation of Liability

To the maximum extent permitted by law, Ad Beast and its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Ad campaign performance, results, or return on investment
  • Actions taken by third-party ad platforms (account suspensions, policy violations, billing disputes)
  • Inaccuracies or errors in AI-generated content

Our total liability for any claim arising from these terms or the use of the Platform shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

12. Termination

Either party may terminate this agreement at any time. You may delete your account through the Platform settings. We may suspend or terminate your access if you violate these terms.

Upon termination, we will delete your account data within 30 days, unless we are required to retain it by law. Active ad campaigns will be paused, and you should disconnect your ad platform accounts before or at the time of termination.

13. Indemnification

You agree to indemnify and hold harmless Ad Beast from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Platform, your violation of these terms, or your advertising content.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved in the courts of competent jurisdiction.

15. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the effective date. Your continued use of the Platform after changes constitutes acceptance of the updated terms.
